2. Changes to these terms and to the site
We may amend these terms from time to time. Please check this page when you visit the site – the terms that apply are those in force on the date you use it. We may also update, suspend or withdraw the site, or any part of it, without notice. We are not obliged to keep the site, or any content on it, available at all times.
3. Using the site
The site is made available free of charge. You may use it for your own personal, non-commercial purposes, and you agree not to:
- use the site in any way that breaches any applicable law or regulation;
- use the site for any purpose that is unlawful or fraudulent, or that has any unlawful or fraudulent effect;
- copy, reproduce, republish, sell, licence or otherwise exploit any part of the site or its content except as permitted in section 4;
- use any automated system to scrape, index, harvest or extract content from the site, or to reproduce or circumvent its navigational structure, other than conventional search engine crawlers acting in accordance with our robots.txt file;
- introduce any virus, trojan, worm, logic bomb or other material that is malicious or technologically harmful;
- attempt to gain unauthorised access to the site, the server on which it is stored, or any server, computer or database connected to it;

We may suspend or withdraw your access to the site if you breach these terms.
4. Artwork images and intellectual property
This section matters more here than on most websites, so please read it carefully.
Copyright in each work of art shown on this site belongs to the artist who made it, or to their estate, and is not transferred to us or to you by the display of that work on this site. Images of artworks are reproduced with the permission of the artists or their representatives for the purpose of exhibiting and offering those works through the gallery.
You may not reproduce, download, copy, print, adapt, distribute, publish or make any commercial use of any image of an artwork appearing on this site without the prior written consent of the copyright owner. This includes use in print, on other websites, on social media, in merchandise, and as training data or input for any machine learning or artificial intelligence system.
Sharing a link to a page on this site is welcome and requires no permission, provided you do so in a way that is fair and lawful, does not damage our reputation or that of any artist, and does not suggest any association, approval or endorsement that does not exist. You must not frame the site on any other website.
All other content on this site – including the site design, layout, text, graphics, logos and the name Coombe Gallery – is owned by us or licensed to us, and is protected by copyright, trade mark and other intellectual property laws.
If you believe any content on this site infringes your rights, please contact us at mark@coombegallery.com and we will respond promptly.
5. Information about artworks
We take care to describe each work accurately, including its artist, medium, dimensions, date and price. Dimensions are given in centimetres and, unless stated otherwise, refer to the work itself rather than the frame.
Some pieces – particularly ceramics, glass and jewellery – do not have a straightforward height and width, and are shown with dimensions available on request. Please contact us and we will give you the measurements that matter for the piece.
Colours reproduced on screen vary between devices and are not a reliable guide to the appearance of a work. We are happy to discuss any work in more detail, provide further images, or arrange a viewing at the gallery.
The availability and price of a work may change. Prices shown include VAT where applicable. We reserve the right to correct any error in a description or price. A price shown on the site is an invitation to enquire and not an offer capable of acceptance; no contract of sale arises until we have confirmed the sale to you in writing. See section 6.
6. Enquiries – there is no online purchasing
You cannot buy anything through this website. There is no basket, no checkout and no payment facility, and we do not take card or bank details through the site. Where a work is available, the site lets you send us an enquiry about it; where a work has sold, the enquiry option is switched off and the work is marked accordingly.
Sending an enquiry places no obligation on you and does not reserve the work. It is not an offer to buy, and our reply is not an acceptance. A sale is agreed separately – in the gallery, or by telephone, email or correspondence – and only once we have confirmed it to you in writing. Payment is arranged directly with us at that point.
Nothing in these terms of use affects your rights as a consumer under English law. If we agree a sale with you without your visiting the gallery, that is a distance contract, and you will have the cancellation rights that apply to such contracts. We will set those out for you in writing before the sale is concluded.
7. Your privacy
We process personal data in accordance with our Privacy Policy, which explains what we collect, why, how long we keep it and the rights you have. Our use of cookies and similar technologies is described in our Cookie Policy.
8. Our liability to you
Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under English law.
If you are a consumer
We do not exclude or limit in any way our liability to you where it would be unlawful to do so. Please note that we provide the site for domestic and private use only, and we will not be liable to you for any loss of profit, loss of business, business interruption or loss of business opportunity.
If you are a business user
We exclude all implied conditions, warranties, representations and other terms that may apply to the site or any content on it. We will not be liable to you for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty or otherwise, arising under or in connection with use of, or inability to use, the site, or use of or reliance on any content displayed on it. In particular, we will not be liable for loss of profits, sales, business or revenue; business interruption; loss of anticipated savings; loss of business opportunity, goodwill or reputation; or any indirect or consequential loss or damage.
Content and viruses
Content on the site is provided for general information only. It is not advice on which you should rely, and we make no representations or warranties that it is accurate, complete or up to date.
We do not guarantee that the site will be secure or free from bugs or viruses. You are responsible for configuring your own information technology and platform to access the site, and for using your own virus protection software.
9. Links to other websites
Where the site contains links to other sites and resources provided by third parties, those links are provided for your information only and should not be interpreted as approval by us of those sites or any information you obtain from them. We have no control over their contents.
10. Accessibility
We want this site to be usable by as many people as possible. If you encounter a barrier to using any part of it, please tell us at mark@coombegallery.com and we will do what we reasonably can to help and to put it right.
11. Governing law
These terms, their subject matter and their formation are governed by English law.
If you are a consumer, you and we both agree that the courts of England and Wales will have exclusive jurisdiction, except that if you live in Scotland you may also bring proceedings in Scotland, and if you live in Northern Ireland you may also bring proceedings in Northern Ireland.
If you are a business, you and we both agree to the exclusive jurisdiction of the courts of England and Wales.
12. Contact us
